By downloading or using MIA — Marine Inspection Assistant (MIA), you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using MIA, you confirm that you are at least 18 years old, have the legal capacity to enter into this agreement, and agree to be bound by these Terms.

Important: This End-User License Agreement (EULA) is concluded between you and the Developer only, and not with Apple Inc. Maksym Stetsenko (the Developer, trading under the marketing name Data Science Enterprise), not Apple, is solely responsible for MIA and its content. This EULA may not provide for usage rules that conflict with Apple's Media Services Terms and Conditions.

MIA is an AI-powered maritime inspection assistant that provides guidance on PSC, SIRE, CDI, ISM, USCG, and ISPS inspections. The service includes:

the Developer grants you a non-transferable license to use MIA on any Apple-branded devices that you own or control, as permitted by the Usage Rules set forth in Apple's Media Services Terms and Conditions. This license may be extended to other accounts associated with you via Family Sharing or volume purchasing where applicable.

⚠️ MIA is an informational tool only. Responses are generated by AI and may contain errors or outdated information. MIA does not replace professional maritime advice, official regulations, or the judgment of qualified maritime officers. Always verify critical information against official sources (IMO, Flag State, Classification Society). The developer is not liable for any consequences arising from reliance on MIA's responses.

the Developer is solely responsible for providing maintenance and support services for MIA, as specified in this agreement or as required by applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to MIA.

7. Warranty

the Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event that MIA fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for MIA to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to MIA. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of the Developer.

You acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to MIA or your possession and use of MIA, including but not limited to:

10. Intellectual Property

MIA and its content are owned by the Developer. You may not copy, modify, or distribute the app or its content without permission. Questions you submit remain yours; responses generated by the AI are provided for your personal use only.

In the event of any third-party claim that MIA or your possession and use of MIA infringes a third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Your use of MIA is governed by our Privacy Policy, which is incorporated into these Terms.

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app settings or by contacting support.

14. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, or consequential damages arising from your use of MIA. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

15. Changes to Terms

We may update these Terms at any time. Continued use of MIA after changes constitutes acceptance. We will notify you of significant changes via the app.

16. Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

17. Governing Law

These Terms are governed by the laws of Ukraine. Any disputes shall be resolved in the courts of Ukraine.
